HEALTH LAW

Health law in Brazil is principally governed by Law No. 8,080/1990, which establishes the legal framework for the Unified Health System (Sistema Único de Saúde – SUS). Legal services in this sector include regulatory compliance, healthcare contracting, professional licensing, and legal oversight of both public and private healthcare operations.

Attorneys represent medical professionals, hospitals, and healthcare institutions in civil, administrative, and disciplinary proceedings. This includes litigation related to medical malpractice, regulatory violations, and ethical misconduct. Legal services also encompass compliance with bioethics standards, enforcement of patient rights, and judicial petitions for access to medical treatments or medications.

Additional areas of practice include public procurement advisory—particularly for companies participating in public tenders to supply pharmaceuticals, hospital equipment, or services—under Brazil’s procurement laws (Lei de Licitações). Legal counsel is also provided for drafting and negotiating contracts with insurance companies, medical distributors, and governmental health agencies.
